<p>On October 5, 2009, the Federal Trade Commission (&#8221;FTC&#8221;) adopted updated &#8220;Guides Concerning the Use of Endorsements and Testimonials in Advertising,&#8221; the first revisions to the Guides since 1980.  These revised Guides will become effective on December 1, 2009.  Importantly, the updated Guides address endorsements and testimonials in &#8220;new media,&#8221; such as blogging.  Bloggers who fail to disclose that they received free products, goods or services from an advertiser may be subject to substantial penalties, although the FTC has indicated it will continue to focus its law enforcement activities on advertisers. We&#8217;ve provided here a short summary of certain key points in the FTC&#8217;s revised Guides; for the full text of the FTC&#8217;s action, see <a href="http://www.ftc.gov/os/2009/10/091005endorsementguidesfnnotice.pdf">http://www.ftc.gov/os/2009/10/091005endorsementguidesfnnotice.pdf </a></p>
<h2><span style="text-decoration: underline;">What is Covered?</span></h2>
<p>The Guides cover &#8220;endorsements&#8221; – &#8220;any advertising message (including verbal statements, demonstrations, or depictions of name, signature, likeness or other identifying personal characteristics of an individual or the name or seal of an organization) that consumers are likely to believe reflects the opinions, beliefs, findings, or experiences of a party other than the sponsoring advertiser, even if the views expressed by that party are identical to those of the sponsoring advertiser.&#8221;</p>
<h2><span style="text-decoration: underline;">General Principles on Endorsements</span></h2>
<p>Endorsements must reflect the honest opinions, findings, beliefs, or experiences of the endorser, and may not convey any express or implied representation that would be deceptive if made by the advertiser.  When the advertisement represents that the endorser uses the endorsed product, the endorser must have been a bona fide user of it at the time the endorsement was given, and while the advertisement continues to run.  Liability may be assessed on advertisers for false or unsubstantiated statements made through endorsements, or for failing to disclose material connections between themselves and their endorsers.  Endorsers may also be liable for statements made in the course of their endorsements.</p>
<p>Further, advertisements that feature a consumer and convey his or her experience with a product or service as typical when that is not the case will be required to clearly disclose the results that consumers can generally expect. The revised Guidelines deleted a provision in the 1980 version of the Guides allowing advertisers to describe unusual results in a testimonial as long as they included a disclaimer such as “results not typical.&#8221;</p>
<h2><span style="text-decoration: underline;">Application to New Media</span></h2>
<p>The development of consumer-generated new media poses new questions about how to distinguish between communications that are considered &#8220;endorsements&#8221; within the meaning of the Guides and those that are not.  The FTC will consider each use of these new media on a case-by-case basis for purposes of law enforcement, similar to other advertising reviewed by the FTC.</p>
<h2><span style="text-decoration: underline;">Factors the FTC will Consider in Reviewing &#8220;New Media&#8221; Endorsements</span></h2>
<p>The revised Guides articulate several factors the FTC will consider in reviewing whether consumer-generated media constitute &#8220;endorsements&#8221; within the meaning of the revised Guides.  The crux of the FTC&#8217;s review is: &#8220;whether, viewed objectively, the relationship between the advertiser and the speaker is such that the speaker&#8217;s statement can be considered &#8220;sponsored&#8221; by the advertiser and therefore an &#8216;advertising message.&#8217;&#8221;  Some key factors that will be analyzed in answering this question are whether, in disseminating positive statements about a product or service, the speaker is:</p>
<ul>
<li> acting solely independently, in which case there is no endorsement; or</li>
<li> acting on behalf of the advertiser or its agent, such that the speaker&#8217;s statement is an &#8220;endorsement&#8221; that is part of an overall marketing campaign.</li>
</ul>
<p>Some indication of &#8220;acting on behalf of the advertiser or its agent&#8221; include:</p>
<ul>
<li> whether the speaker is compensated by the advertiser or its agent;</li>
<li> whether the product or service in question was provided for free by the advertiser;</li>
<li> the terms of any agreement;</li>
<li> the length of the relationship;</li>
<li> the previous receipt of products or services from the same or similar advertisers, or the likelihood of future receipt of such products or services; and</li>
<li> the value of the items or services received.</li>
</ul>
<p>The FTC has indicated that a consumer who purchases a product with his or her own money and praises it on a personal blog will not be deemed to be providing an endorsement.  However, a blogger who is paid to speak about an advertiser&#8217;s product will be covered by the FTC&#8217;s endorsement Guides.  Further, if a consumer received a single unsolicited item from a manufacturer and wrote positively about it on a blog, the review is unlikely to be considered an endorsement, because of the absence of a course of dealing with that advertiser that would suggest that the consumer is disseminating a &#8220;sponsored&#8221; advertising message.  In contrast, a blogger who regularly receives free samples of products for families of young children and discusses those products on his or her blog would be required to disclose that he or she received for free the recommended items.  Also, the receipt of a single, high priced item could constitute a material connection between an advertiser and an endorser that would be required to be disclosed..</p>
<p>Endorsers are responsible for disclosing material connections with advertisers.  Some industry groups (such as the Word of Mouth Marketing Association) already require these disclosures in their codes of ethics.  Advertisers who sponsor endorsers must establish procedures to advise endorsers that they should make the necessary disclosure and monitor endorsers&#8217; conduct.</p>
<h2><span style="text-decoration: underline;">Liability</span></h2>
<p>An advertiser may be liable under Section 5 of the FTC Act for a blogger&#8217;s misleading statements if the advertiser initiated the process that led to these endorsements being made. Moreover, both the advertiser and the blogger are subject to liability for misleading or unsubstantiated representations made in the course of the blogger&#8217;s endorsements. The FTC indicates that its law enforcement activities will continue to focus on advertisers.  However, endorsements by bloggers are now covered by the Guide and bloggers should be careful to review the revised Guide and the examples provided by the FTC.</p>

			<content:encoded><![CDATA[<p>So I got asked a few months ago to present at the GrowSmartBiz Conference and I suggested to do something on business cards. I am sure many people were like &#8220;ok&#8230;.&#8221; It can be a dry subject unless you find the examples of business cards I did and relay some solid and clever rules to create &#8220;Killer&#8221; business cards.</p>
<p>This is a presentation that is usually given in 30 minutes and I did it in about 10. It was rapid fire and from the Twitter stream and the high fives I got, it went over really well. 			<content:encoded><![CDATA[<p>Last year, <a href="http://blog.networksolutions.com/2008/steve-and-shashi-are-heading-to-gnomedex-2008-this-week/">Shashi and your humble correspondent attended</a> one of the most rocking tech conferences on the continent, <a href="http://www.gnomedex.com">Gnomedex</a>.</p>
<p>It is put on by, <a href="http://chris.pirillo.com/">Chris Pirillo</a>, the Original Gnome or &#8220;OG&#8221; and his Lockergnome crew in the beautiful city of Seattle. As I said in my post last year, &#8220;I have been to many conferences in the past and I have to say this is one of the best out there. Little things like working wi-fi for everyone, power in every seat to make your liveblogging acheiveable and awesome food that you would find at really expensive conferences&#8221;. This Gnomedex should be no different. In fact there will be a few surprises for us to announce as the date gets closer.</p>
<p>The Network gang attending Gnomedex this year has grown to include <a href="http://www.twitter.com/thekenyeung">Ken Yeung</a>, I am sorry, <a href="http://www.twitter.com/thekenyeung">&#8220;The&#8221; Ken Yeung</a> as he is known to all his fans (including me).</p>
<p>Like many conferences, the best conversations are usually in the hallways and this conference is one par with SXSW in that vein. Gnomedex has actually come to be known as the &#8220;affordable TED for everyone&#8221;. I really like that and suggested three years ago that Chris call the conference &#8220;GnomeTED&#8221;. Chris limits attendance to around 350-400 which makes it possible to meet almost everyone if you work hard and he really leverages web tools to connect people and employs backchannels like IRC and Twitter live to show what people are thinking as the presenter is speaking. He also does a live video feed for fans who can&#8217;t be there.</p>
<p>To check out who will be there in addition to Shashi and me, here is the <a href="http://www.gnomedex.com/profiles/members/">attendee list</a> (another great thing that most conferences don&#8217;t do) and <a href="http://www.gnomedex.com/page/speakers-1">the agenda</a> which is going to be entertaining and educational.</p>
<p><span style="text-decoration: underline;"><strong>Blogging from Gnomedex</strong></span></p>
<p>We will be blogging from the conference every day (Thursday-Saturday) and capturing lots of interviews that should be rolling off the presses for publishing next week and into September. Ken will also be taking lots of awesome pictures that will be part of a Flickr feed we will have online soon.</p>

<p>“<strong>Technophobia</strong> is the fear or dislike of advanced technology or complex devices, especially computers.[1] The term is generally used in the sense of an irrational fear, but others contend fears are justified.” (<a href="http://www.wikipedia.com">www.wikipedia.com</a>). I was surprised to find that technophobia is as old as the Industrial Revolution!</p>
<p>Many therapists are technology averse, or don’t know where to begin, or don’t know what they don’t know . . . as opposed to being actually technophobic. Don’t let that stop you from harnessing technology to your advantage. We can joke all we want about using a desensitization process, or EMDR, but the bottom line is that technology can help you in your practice.<br />
First, ask yourself what the technology is for? What results are you seeking? Do you want a website and/or do you want technology for business use (such as billing, tracking financials, writing reports, etc.) We’ll look at websites in this article and discuss business uses separately.</p>
<p><span style="text-decoration: underline;"><strong>Things to Consider for Your Website</strong></span><br />
Let’s break it down into small steps.</p>
<p style="padding-left: 30px;">1.    So you want a website. What features do you want and why. You can have an information only website, or one that is interactive such that a client can schedule appointments, pay online, etc. Many “bells and whistles” exist so it’s important to keep focused on the results you’re seeking.<br />
2.    What’s your budget? $500 or $5000?<br />
3.    Can/should you do it yourself or outsource it?<br />
4.    Finding a website provider</p>
<p>Consider what features you want and why you want them (this will save money). Just like writing a paper in school; answer who, what, where, when and why. I want clients and potential clients to know what I do – my areas of specialty, where I am and how to get there, how I work, my general philosophy about therapy, and to provide resources for them. I have sections specific to grief, to couples, and to Personality Mapping, including a registration form that can be printed, completed and faxed. Other options may include email contact (consider legal and ethical issues of timeliness), online payment or appointment scheduling, databases, and so on. Use technology to support your business the way you want to conduct your business.</p>
<p><span style="text-decoration: underline;"><strong>Your Budget</strong></span><br />
What are you willing and able to spend on your website? This will help determine the features you select, whether you build it yourself or have someone else build it. Keep it simple, especially at first. Beware of “feature creep” – this can happen in any project. You begin by wanting to update your kitchen; just new knobs and paint. The next thing you know you’re tearing out cabinets and putting in granite countertops! This happens with technology all the time, too. Decide what is essential and what would be nice to have.</p>
<p><span style="text-decoration: underline;"><strong>Can/Should You Do it Yourself or Outsource it?</strong></span><br />
There are really two parts to this question: are you comfortable enough and do you have the time to build your own website? Outsourcing is a fancy way of saying that you’re hiring someone else to use their expertise for your benefit. Trust your intuition in this decision.</p>
<p><span style="text-decoration: underline;"><strong>Finding a Website Provider</strong></span><br />
Here are a few important tips for finding a website provider:</p>
<p style="padding-left: 30px;">-    Look at sites you like; who did them?<br />
-    Remember that when you search the internet for providers, the first providers are usually the ones that pay to be first.<br />
-    Ask your network of colleagues for referrals to three website vendors. Check their references and be sure to ask how problems were resolved, if the site was done in a timely manner, etc.<br />
-    How long has the provider been in business?<br />
-    Check the Better Business Bureau<br />
-    Check your local chamber of commerce.</p>
<p>There are three parts to having a website: 1) the domain name (the URL or <a href="http://www.yourwebsite.com">www.yourwebsite.com</a>), 2) hosting the website itself (a server that has your website on it), and 3) developing the website (the features and content structure – you will provide the actual content). Providers offer one, two or all three services. For example, I use Network Solutions. I was able to search for and have them register my domain names (<a href="http://www.chandramaanderson.com">www.chandramaanderson.com</a> and <a href="http://www.personalitymap.com">www.personalitymap.com</a>); my website is on their servers, and I used their simple drag and drop system to create my site with the features I wanted. One can also pay them to develop your website.</p>
<h2><strong>What Options Are There For Therapists?</strong></h2>
<p><span style="text-decoration: underline;"><strong>Canned Solutions</strong></span><br />
Just like in cooking, you can buy broth for your base, or you can buy a chicken and make broth. Any feature you want for your website already exists: email, electronic commerce, appointment systems, and so on. If you feel comfortable, you can put together a website yourself by finding a provider that has drag and drop canned solutions. You select the overall look of your site, easily add content, additional pages, and so on. You should plan on spending several hours if you do it yourself. Doing the basic set up is pretty quick; it can be done in a couple of hours. If you want it to look just so, it takes time to tweak it.</p>
<p><span style="text-decoration: underline;"><strong>Vendor Using Canned Solutions</strong></span><br />
A middle of the road solution is to hire a web developer that will take care of the three parts to having a website using existing modules. This is probably the best bang for your buck.<br />
<span style="text-decoration: underline;"><strong></strong></span></p>
<p><span style="text-decoration: underline;"><strong>Vendor Personalizes a Website for Your Business</strong></span><br />
Another middle of the road option is to find a local provider that will meet with you to determine your needs. You provide the images or logos and your content, and they will build a two to three page site for you. This may cost in the $500-800 range, plus hosting, which is about $15-20/month. Anything more than two to three pages of content can start to climb over the $1200 mark, depending on design, functionality, etc.</p>
<p>These two types of vendor solutions are probably the choice most therapists will want to make, since it is the most cost effective (other than DIY &#8212; doing it yourself) and will provide the results you want.</p>
<p><span style="text-decoration: underline;"><strong>Proprietary Website Development</strong></span><br />
Proprietary development means hiring a web developer that will write software code to provide the features you want. You need to know very specifically what you want, what you want those features to do, etc. A large company may have strategic reasons for wanting proprietary code; as therapists, most of us just want to provide information to make it easy for clients to find us online and at our office.</p>
<p><span style="text-decoration: underline;"><strong>Next Steps</strong></span><br />
Hopefully by now you have the terminology to ask yourself what you want and need, what your budget is, and have decided whether to be a DIYer or to hire a vendor, and what to ask when you interview providers for your website. So, pick up your phone and call your trusted colleagues to ask who they used for their website. Knowledge is power; you don’t have to be technophobic no more!</p>

<p>Changes include a repackaging of how <a href="http://www.networksolutions.com">Network Solutions</a> is offering its solutions to customers and new pricing to reflect the feedback we have received. I the interest of full disclosure, my business and my non-profit are both Network Solutions customers. As a customer I am excited to see the improvements and it has fixed many problems that I myself have had challenges with in the past. In a nutshell, Network Solutions has been listening and this is the result.</p>

<p>Each of these sites make good cases, describe the plugins well and even have pretty screen shots. So in order to add value and create a great post, I thought I would actually review both and see about giving you a best practices list. The descriptions are quoted from their respective web sites.
